2. SUBJECT OF THE AGREEMENT

This Distance Sales Agreement (the "Agreement") regulates the rights and obligations of the parties in accordance with the provisions of the Law on Consumer Protection No. 6502 and the Regulation on Distance Contracts regarding the sale and delivery of the goods or services, the characteristics and sales price of which are specified below, ordered electronically by the BUYER via www.samsunpazari.com ("Website").

The information in the e-mail and invoice sent to the BUYER after the order shall be taken as basis.

4. DELIVERY

  • Product(s) will be sent to the address specified by the BUYER during the order.

  • Delivery time shall not exceed 30 (thirty) days from the payment confirmation.

  • Unless otherwise stated, shipping fee belongs to the BUYER. If the Seller has a free shipping campaign, the cost belongs to the SELLER.

  • The BUYER is responsible for any expenses incurred if the BUYER is not at the address or does not receive the delivery at the time of delivery.

5. PAYMENT

  • The product price is collected through the iyzico infrastructure, the payment service provider.

  • When the BUYER completes the payment process, the amount is deemed to have been paid to the SELLER.

  • If the payment is not approved or cancelled, the SELLER's delivery obligation ends.

6. RIGHT OF WITHDRAWAL

  • The BUYER may exercise the right of withdrawal within 14 (fourteen) days from the delivery of the goods without any justification.

  • For the right of withdrawal, the BUYER must create a return request via the www.samsunpazari.com account to obtain a return code or notify info@samsunpazari.comr.

  • For the right of withdrawal, the returned product must be sent complete and undamaged, including the invoice, packaging, box, accessories, and any gift products, if any.

  • If the BUYER sends the product with the SELLER's contracted shipping company, the return shipping fee belongs to the SELLER. If another shipping company is preferred, the cost belongs to the BUYER. For outlet and discounted products, shipping belongs to the BUYER.

  • The SELLER shall return the product price within 14 (fourteen) days at the latest from the date the withdrawal notification reaches him, in a manner appropriate to the payment instrument used by the BUYER.

7. CASES WHERE THE RIGHT OF WITHDRAWAL CANNOT BE USED

By law, the right of withdrawal cannot be used for the following products:

  • Goods produced in line with the BUYER's wishes or personal needs,

  • Products that are likely to spoil quickly or whose expiration date may pass,

  • Food, cosmetic, hygiene products whose packaging has been opened after delivery,

  • Goods that are mixed with other products after delivery and cannot be separated,

  • Opened books, software, digital content, DVDs, CDs, computer consumables,

  • Services performed instantly in electronic environment and digital products (gift vouchers, etc.).

  • There are no refunds for outlet and discounted products, only exchanges.

8. BUYER'S OBLIGATIONS

  • The BUYER accepts that the information provided during the order is correct. The BUYER is responsible for any damages arising from incorrect information.

  • The BUYER is obliged to check the product upon receipt. If a damaged product is received, the responsibility belongs to the BUYER.

9. SELLER'S OBLIGATIONS

  • The SELLER is obliged to send the products in accordance with the legislation, sound, complete, and with their invoice.

  • If delivery becomes impossible, the SELLER shall notify the BUYER within 3 days and refund the collected amount within 14 days at the latest.

10. RESOLUTION OF DISPUTES

In disputes arising from this Agreement, the Consumer Arbitration Committees at the BUYER's place of residence or where the purchase was made, within the monetary limits announced annually by the Ministry of Customs and Trade, are authorized; in disputes exceeding the specified amount, the Consumer Courts are authorized.

11. DEFAULT AND LEGAL CONSEQUENCES

If the BUYER defaults on transactions made with a credit card, the BUYER is responsible for interest and expenses within the scope of the agreement made with the cardholder bank.

12. EFFECTIVENESS

The BUYER accepts that they have approved the preliminary information form and this agreement electronically for the order placed through the Website, and that they undertake the obligation to pay when placing an order.

This agreement has been concluded electronically and is stored by the parties.
