Membership Agreement
MEMBERSHIP AGREEMENT
Please read the following agreement carefully before becoming a member of our site.
1. Parties
a) Activities of the www.samsunpazari.com website are conducted by ZEYNEP İREM BOZKURT / SAMSUN PAZARI (hereinafter referred to as "SELLER") residing at Kale mahallesi 19 mayıs bulvarı Cumhuriyet işhanı no:10/1 İlkadım /Samsun.
b) The internet user who is a member of the www.samsunpazari.com website (hereinafter referred to as "Member").
2. Subject of the Agreement
The subject of this Agreement is to determine the terms and conditions under which the Member can benefit from the website www.samsunpazari.com, which is owned by ZEYNEP İREM BOZKURT / SAMSUN PAZARI.
3. Rights and Obligations of the Parties
3.1. The Member declares and undertakes that the personal and other information provided when becoming a member of the www.samsunpazari.com website is accurate under the law, and that they will immediately and completely compensate the SELLER for any damages incurred due to the inaccuracy of this information.
3.2. The Member shall not give the password provided to them by the SELLER to other individuals or organizations; the right to use the said password belongs exclusively to the Member. For this reason, the SELLER reserves the right to claim any compensation and other demands arising from unauthorized use by third parties or authorized authorities against the SELLER.
3.3. The Member accepts and undertakes from the outset to comply with legal regulations and not to violate them while using the www.blacksamplejewellery.com website. Otherwise, all legal and criminal liabilities that may arise shall fully and exclusively bind the member.
3.4. The Member shall not use the www.samsunpazari.com website in any way that disrupts public order, violates general morality, harasses or disturbs others, for an unlawful purpose, or in a way that infringes on the intellectual and copyright rights of others. Furthermore, the member shall not engage in activities (spam, viruses, Trojan horses, etc.) or actions that prevent or make it difficult for others to use the services.
3.5. Ideas and opinions declared, written, and used by members on the www.samsunpazari.comwebsite are entirely the members' personal views and bind the opinion owner. These views and opinions have no connection or link with the SELLER. The SELLER shall not be liable for any damages that third parties may incur due to the ideas and opinions declared by the member, or for any damages that the member may incur due to the ideas and opinions declared by third parties.
3.6. The SELLER shall not be responsible for unauthorized reading of member data by unauthorized persons and for any damage that may occur to member software and data. The Member has accepted in advance not to claim compensation from the SELLER for any damage that may arise from the use of the www.samsunpazari.comwebsite.
3.7. The member has agreed not to access or use the software and data of other internet users without permission. Otherwise, all legal and criminal liabilities arising from this belong entirely to the member.
3.8. The member who violates one or more of the articles listed in this membership agreement shall be personally responsible criminally and legally for this violation and shall keep the SELLER free from the legal and criminal consequences of these violations. Furthermore, in case of a legal action due to this violation, the SELLER reserves the right to claim compensation from the member for non-compliance with the membership agreement.
3.9. The SELLER always has the right to unilaterally delete the member's membership, and to delete the customer's files, documents and information when necessary. The member accepts this disposition in advance. In this case, the SELLER has no responsibility.
3.10. The software and design of the www.samsunpazari.comwebsite are the property of the SELLER, and the copyright and/or other intellectual property rights related thereto are protected by relevant laws, and cannot be used, acquired or changed by the member without permission. Other companies and products mentioned on this website are trademarks of their owners and are also protected under intellectual property rights.
3.11. Some information such as the name of the Internet service provider used to access the site and its Internet Protocol (IP) address, the date and time of access to the site, the pages accessed while on the site, and the Internet address of the website providing direct connection to the site, may be collected by the SELLER for the purpose of improving and developing the www.samsunpazari.comwebsite and/or within the framework of legal regulations.
3.12. The SELLER may disclose the member's personal information when required as a legal obligation or when the SELLER, in good faith, deems it necessary to (a) comply with legal requirements or legal processes served on the SELLER; (b) protect and defend the rights and property of the SELLER and the SELLER website family.
3.13. The SELLER has taken measures within the available means to ensure that the website is free from viruses and similar malicious software. In addition, for the ultimate security, the user must provide their own antivirus system and ensure the necessary protection. In this context, by accessing the SELLER website, the member is deemed to have accepted that they are responsible for all errors that may occur in their own software and operating systems and for the direct or indirect consequences thereof.
3.14. The SELLER reserves the right to change the content of the site, modify or terminate any service provided to users, or delete user information and data registered on the SELLER's website at any time.
3.15. The SELLER may change, update, or cancel the terms of the membership agreement at any time without prior notice and/or warning. Each modified, updated, or abolished provision will take effect for all members on its publication date.
3.16. The parties acknowledge and declare that all computer records belonging to the SELLER will be taken as the sole and true exclusive evidence, in accordance with HUMK Article 287, and that said records constitute an evidence agreement.
3.17. The SELLER has the authority to send informational emails to the electronic mail addresses registered to its members and informational SMS messages to their mobile phones, and by approving this membership agreement, the member shall be deemed to have accepted the sending of informational emails to their electronic mail address and informational SMS messages to their mobile phone.
4. Termination of the Contract
This agreement will remain in effect until the member cancels their membership or until their membership is canceled by the SELLER. The SELLER may unilaterally terminate the agreement by canceling the member's membership if the member violates any provision of the membership agreement.
5. Resolution of Disputes
Istanbul Courts and Enforcement Offices are authorized for disputes related to this contract.
6. Effectiveness
The member registering for membership means that the member has read all the articles in the membership agreement and has accepted the articles in the membership agreement. This Agreement was concluded at the time of the member's membership and entered into force mutually.
